INDEMNIFICATION AGREEMENT Band Spaces LLC, licensor, 180-188 N. 14th Street (Brooklyn NY 11211); and 208 6th street aka 410 3rd Ave (Brooklyn NY 11215) studios; and and any and all other addresses where Band Spaces LLC performs the business of licensing, renting or subletting music space (hereinafter, collectively, "the Studios"). Each of the terms "I", "my", "you, "your" refers to you, the person renting, licensing or using space in the Studios. THIS IS A LEGALLY BINDING LIABILITY RELEASE, WAIVER, EXPRESS ASSUMPTION OF RISK, INDEMNIFICATION, AND COVENANT NOT TO SUE (the “Release”) THAT AFFECTS YOUR LEGAL RIGHTS. By reading this Release and by continuing to rent in our studio(s), you forever give up all your rights to recover compensation or obtain any other remedy for any injury to yourself (or death), or for any loss of, or damage to, your property, arising out of your use of the rehearsal facilities at the Studios. You hereby grant and agree that each of the following statements is true and correct: 1. I hereby affirm that I have carefully read this Release in its entirety and agree to each and every term and condition of this Release. 2. I hereby submit that any injury that I (or any invitee or any person or persons I may bring to, or cause to enter or visit the Studio, or of any member of my band or group, collectively, my "Invitees") sustain while on or near the premises of the Studios is not the responsibility of any of the following: Band Spaces LLC, any owner(s) of the premises of the Studio, nor any of their respective managers, employees, assigns, representatives or successors. 3. I understand that neither Band Spaces LLC, any owner(s) of the premises of the Studio, nor any of their managers, employees, assigns, representatives or successors is responsible for any equipment or property which I, or any Invitee, may leave on the premises of the Studios and I and any of my Invitees hereby waive any right to sue Band Spaces LLC, any owner(s) of the premises of the Studio, or any of their managers, employees, assigns, representatives or successors, in the event said property is lost or damaged at, or burglarized or stolen from, the Studios. 4. I agree that I, and any Invitees, will abide by all room rules and guidelines, as outlined on the BandSpacesNYC.com website and in the “Studio Information” email I receive from Band Spaces NYC. 5. I promise to distribute or cause to read this Agreement to every Invitee who uses the Studios. 6. I understand that the Studios are not to be used as a living space and are for use as music studios only. 7. I am 18 years of age or over. By clicking on the "I AGREE" button, and/or by licensing a room/slot in the Studios, you are indicating you have read this Agreement and agree to be bound by the terms of this Agreement and this Agreement supersedes all previous agreements, communications, oral or written, and all other communications.
